Preamble
Kapi is software for beauty salons. It gives the salon, its staff and its clients the tools to book, keep client files and formulas, charge, sell and stay in touch.
These terms are the general framework of that relationship. They are complemented by the Privacy policy, the Help and support page and the Delete your account page. If anything conflicts, these terms prevail, except on matters those documents govern specifically.
Kapi is used under the laws of Colombia and the principles of good faith, transparency and respect for people's rights, especially the rights of anyone using Kapi as a consumer.
General provisions
1. Purpose
These terms govern registration, access to and use of Kapi, and the rights and obligations of Kapi and of each person according to their role on the platform.
2. Scope
They apply to anyone who visits Kapi, creates an account or uses any part of it: the web panel, the iOS and Android app and this site. They apply from the first visit and for as long as the relationship lasts, including what must be done after it ends, such as handling a claim.
3. Acceptance
To create an account you must read and accept these terms by ticking the acceptance box. That electronic acceptance is as valid as a signed one, under Law 527 of 1999. Kapi keeps the date and the version you accepted. If you do not agree with these terms, do not use Kapi.
4. Capacity
To open a salon account you must be of legal age and have legal capacity, or act on behalf of the salon with authority to do so. Kapi is not directed at children under 14. A client under 18 may only use Kapi with consent from her parent or legal guardian. You agree to give true information and keep it up to date.
5. Definitions
- Kapi: the software and its owner, Juan David Otero Torres, an independent developer based in Cali, Colombia.
- Platform: the web panel, the iOS and Android app and this site.
- Salon: the beauty business that subscribes to Kapi, with one or more branches.
- Owner: the person who creates the salon account and manages it. A salon can have more than one.
- Staff: the admins and stylists the salon invites.
- Client: the person the salon serves, who uses the app to see her appointments and history and to buy in the salon shop.
- Subscription: the plan the salon pays to use Kapi.
Kapi and the platform
6. What Kapi is
Kapi is a technology tool. It is not a salon, does not provide beauty services, does not sell the products in the salon shop, is not the employer of the salon staff and is not a financial institution. Relationships between the salon, its staff and its clients belong to them.
7. Scope of the platform
With Kapi the salon manages its schedule, clients, formulas, photos, inventory, cash register, shop, commissions and invoicing. Clients see their appointments, photos and care plan, and buy in their salon's shop. Features may change over time. If we remove or change something important, we give notice in advance when possible.
8. Kapi's role
Kapi provides the technology, maintains it, protects it and gives support. It does not direct the salon's work or answer for the obligations each salon has to its staff or clients.
9. Salon autonomy
The salon decides its services, prices, hours, products, commissions and how it serves its clients. Using Kapi does not create a partnership, employment relationship, agency or exclusivity between Kapi and the salon.
10. Automatic suggestions
When Kapi shows suggestions, for example from Lía, they are an aid: they always say why they appear and you can dismiss them. They are not a diagnosis or professional advice. Every decision about a service, formula or product is the salon's.
Who takes part
11. The salon and its owner
The owner creates the salon account, chooses the plan, invites the staff, defines what each role can do and answers for how the salon's accounts are used.
12. Staff
Admins and stylists use Kapi at the salon's invitation and according to the role the salon gives them. Their relationship with the salon is independent of Kapi.
13. Clients
Clients use Kapi at their salon's invitation. Appointments, services, prices and products are offered by the salon, not by Kapi. If you have a question about a service, an order or a payment, write to your salon.
14. Client data belongs to the salon
The salon is the controller of the data it records about its clients and Kapi processes it on the salon's behalf. So the salon agrees to:
- Ask each client for consent before recording her technical history or photos or writing to her on WhatsApp.
- Use the data only to serve the client and not share it outside the salon.
- Handle its clients' requests about their data within the legal time limits.
- Keep its staff passwords confidential and remove access for anyone who no longer works at the salon.
15. Everyone's obligations
Anyone who uses Kapi agrees to:
- Give true, complete and up-to-date information.
- Look after their password and tell us if someone entered their account without permission.
- Use Kapi according to the law and these terms, and respect other people's rights.
- Fulfil what they agree with the salon or with its clients.
- Respond to reasonable requests from Kapi needed for the security and proper operation of the service.
16. Prohibited use
You may not:
- Record data about people without their consent, or false data.
- Upload photos or content that does not belong to you or that violates other people's rights.
- Try to access accounts or data of other salons or people.
- Copy, reverse engineer or overload the service, or use it to send unwanted messages or for illegal purposes.
Using the service
17. Appointments, sales and shop
Appointments, services and sales are recorded according to the available features and the rules each salon sets, such as hours, deposits or cancellations. Those rules are set by the salon, which is responsible for honoring them.
18. Messages and WhatsApp
Kapi sends notices inside the app and by email. Kapi does not send WhatsApp messages: when you or the salon choose to write on WhatsApp, the app opens the salon's chat with a ready-made message and the person sends it. The salon may only write on WhatsApp to people who authorized it.
19. Records
Kapi keeps a history of what happens on the platform, such as appointments, changes, payments and consents, so the service works, to handle claims and to comply with the law. That history serves as evidence of what happened, without prejudice to your right to dispute it.
20. Suspension for breach
If someone breaks these terms or puts the security of Kapi or other people at risk, we may limit or suspend their account. We give notice beforehand and explain the reason when possible.
Subscription and payments
21. Plans and free trial
Kapi is offered as a monthly or annual subscription. Plans, their prices in Colombian pesos and what they include are shown on this site and on the Kapi web app before you pay. The salon starts with a 30-day free trial, with no card required. Plans are chosen and paid on the Kapi web app, not inside the mobile app or in the Apple or Google stores.
22. Billing
Charges are processed by Wompi, which has its own terms. Kapi does not store card data. With payment methods that can be saved, the charge runs automatically each period. With the others, the owner pays each period from the web and we remind her beforehand. For each charge Kapi issues the document tax law requires.
23. Plan changes
Upgrading or adding stylists or branches applies immediately and the difference is charged for the days left in the period. Downgrading or removing extras applies from the next period, with no refund. We show you the calculation before you confirm.
24. Failed payment, read-only and suspension
- If a charge fails, we retry for 5 days and notify the owner.
- If the trial ends without payment or the charge still fails, the salon is read-only for 5 days: staff can see information but cannot create or edit anything, and the owner can export her data.
- Then the salon is suspended. If the owner pays before deletion, everything goes back as it was.
- 60 days after suspension we delete the salon's information. We notify the owner 7 days and 1 day before.
25. Cancellation
The owner can cancel at any time from the web, on her subscription page. Cancellation applies at the end of the paid period; from then on the salon follows the same read-only, suspension and deletion path. She can undo the cancellation before the period ends.
26. Client payments to the salon
When a client pays for a salon product or service in the app, the payment is processed by Wompi and the money goes to the salon. The salon is the seller: it delivers, invoices and is responsible for warranties, exchanges, withdrawal and returns under the Colombian Consumer Statute (Law 1480 of 2011).
27. Salon e-invoicing
If the salon invoices from Kapi, the invoices are issued by the salon, under its own resolution, through a technology provider authorized by the DIAN. The salon is responsible for its invoice information and its taxes.
Support and claims
28. Support channels
Salon staff have a support chat inside the app. Anyone can write to us at juanoterot@outlook.com or on WhatsApp at +57 312 600 6315. Steps and time limits are on the Help and support page.
29. Claims about Kapi
If something in Kapi does not work as it should or you disagree with a subscription charge, write to us. We review the case, tell you what we found and what we will do, and answer within 15 business days.
30. Claims about the salon
Claims about a service, product, order or payment made to the salon are handled by the salon. If you write to us, we guide you and pass your message on to the salon when possible.
31. Personal data
Requests and claims about personal data follow the procedure and time limits of the Privacy policy.
32. Consumer rights
Nothing in these terms limits the rights the law gives you as a consumer, including warranty, withdrawal and payment reversal when they apply.
Liability
33. General principle
Each party answers for what corresponds to its role. Several people taking part in the same appointment or sale does not make them jointly liable, unless the law says so.
34. Kapi's liability
Kapi is responsible for maintaining the platform, protecting data under the Privacy policy, providing support and complying with these terms. We work to keep Kapi running at all times, but there may be pauses for maintenance or third-party failures. If we plan a long pause, we give notice in advance.
35. Liability of the salon and users
The salon is responsible for its services, products, prices, formulas, invoices, staff and the data it records. Each person is responsible for the information they give and the use of their account.
36. Limits
Kapi is not liable for damage caused solely by the salon, its staff or its clients, by false or incomplete information, by force majeure or acts of God, or by failures of third-party services beyond our control. To the extent the law allows, our liability to a salon is limited to what it paid for the subscription in the last three months. These limits do not apply where the law does not allow liability to be excluded.
37. Intellectual property
The software, the brand, the name Lía, the designs and the texts of Kapi are ours or we have the right to use them. Using Kapi gives you no rights over them beyond using the service.
38. Your data and content
Your data and your salon's data are yours. You allow us to store and display it only to provide the service. You can download it and, when you delete your account, we delete it under the Privacy policy.
Final provisions
39. Kapi documents
These terms, the Privacy policy, the Help and support page and the Delete your account page are read together. Each one governs its own subject.
40. Changes to these terms
We may change these terms because of changes in the law, technology or the service. We publish the new version here with its number and date. If the change is important we notify you in the app before it applies and, when the law or the change requires it, ask you to accept them again.
41. Governing law and disputes
These terms are governed by the laws of Colombia. If a disagreement arises, we first try to resolve it through the support channels. This does not prevent you from going to the Superintendence of Industry and Commerce or the courts of Colombia.
42. Severability
If any part of these terms is not valid, the rest remains in force.
43. Effective date
These terms are effective from October 12, 2026 until we publish a new version. For any question write to us at juanoterot@outlook.com.
